The CCMA has accredited MIBCO to manage a wide range of labour disputes in the motor industry. In fulfilling this mandate, MIBCO established the Dispute Resolution Centre (DRC), which mirrors CCMA processes and is overseen by full-time, accredited Commissioners. The DRC operates through regional offices located throughout South Africa.

Frequently Asked Questions

Q: Does the DRC deal with all disputes in the Motor Industry?

No. The DRC deals with most employment disputes in the Motor Industry.  Some employment disputes, such as unfair discrimination cases, must go to the CCMA here: www.ccma.org.za. Wage and other collective agreement complaints must be lodged at your local MIBCO office. Commercial disputes within the industry can be referred to the Ombudsman for the Motor and related Industries: www.miosa.co.za

Q: Are the DRC services free of charge?

Yes, the service is free of charge.

Q: How do I refer a dispute?

Submit a referral form (Form 7.11) within 30 days for dismissal or 90 days for an unfair labour practice.

Q: What if I referred my dispute outside the 30 or 90 days?

If you file your dispute late you must apply for condonation and explain the reason for the delay.

Q: I have referred a dispute, what now?

The DRC will invite the parties to an informal conciliation meeting, and if unresolved, the case may go to final arbitration.

Q: Can I bring someone to represent me?

Yes. Employees may bring a union representative or fellow employee. Employers may be represented by an employer’s organisation. Attorneys must make an application to represent you in misconduct and incapacity matters.

Q: What if someone does not show up to the hearing?

The hearing may continue in their absence.

Q: I am unable to attend the process. What should I do?

You must inform the DRC in writing as soon as possible and provide valid reasons. You may request a postponement, but postponement is not guaranteed and must be approved by the Commissioner.

Q: I missed my DRC appointment. What can I do?

Contact the DRC immediately. If an award was issued or you case was dismissed, you can apply for a rescission within 14 days.

Q: I have won my case, but the employer does not comply, what do I do?

You can apply to the DRC to have the award enforced and executed by the Sheriff.
